Process Server Pricing in San Jose & Santa Clara County
Get Em Served offers clear process-serving pricing for civil and family law assignments throughout San Jose and Santa Clara County. Choose Routine, Priority, Urgent or On-Demand service based on the scheduling needs of your assignment.
Unless otherwise stated, process-serving rates apply to one recipient at one authorized service address and include up to three service attempts.
Civil Process Serving Pricing
Routine Civil Service — $150
Routine Civil Service includes up to three attempts for one recipient at one authorized service address. Service is generally completed within a 10 to 14 day service cycle, depending on recipient availability, access and assignment circumstances.
Priority Civil Service — $200
Priority Civil Service generally provides a first service attempt within 48 hours and includes up to three attempts during a 7 to 10 day service cycle.
Urgent Civil Service — $250
Urgent Civil Service generally provides a first service attempt within 24 hours and includes up to three attempts during a 5 to 7 day service cycle.
On-Demand Civil Service — $300
On-Demand Civil Service generally provides a first service attempt within five business hours and includes up to three attempts during a 3 to 5 day service cycle. Orders received outside normal business hours may begin the next business day.
Family Law Process Serving Pricing
Family law assignments use a separate pricing schedule. Get Em Served handles process service for divorce, custody, support and other family-related matters throughout Santa Clara County.
Routine Family Service — $250
Routine Family Service includes up to three service attempts and generally operates within a 10 to 14 day service cycle.
Priority Family Service — $300
Priority Family Service generally provides a first attempt within 48 hours and includes up to three attempts during a 7 to 10 day service cycle.
Urgent Family Service — $350
Urgent Family Service generally provides a first attempt within 24 hours and includes up to three attempts during a 5 to 7 day service cycle.
On-Demand Family Service — $400
On-Demand Family Service generally provides a first attempt within five business hours and includes up to three attempts during a 3 to 5 day service cycle. Orders received outside normal business hours may begin the next business day.
What Is Included With Process Serving?
Unless your invoice, written quote or service-specific terms state otherwise, process-serving pricing generally covers one recipient at one authorized service address with up to three service attempts.
Service attempts may be scheduled on different dates and at different times based on the service level purchased, recipient availability, known schedule, property access and the circumstances of the assignment.
Following completion of the assignment, the appropriate proof of service, declaration of non-service, due-diligence declaration or other applicable service record may be prepared.
Additional Attempts and Additional Addresses
Additional service attempts after the included attempt cycle may be available for 50% of the original service rate where applicable.
Additional recipients, defendants, service addresses, replacement addresses, workplaces or other locations are not automatically included in the original service fee and may require additional payment.
If the original address is incorrect, vacant, outdated, inaccessible or no longer associated with the recipient, service at another address may require a separate charge.

Waiting and Stakeout Service
Extended waiting, observation or stakeout-type assignments are available when appropriate and are billed at $80 per hour. Availability and the expected scope of the assignment should be confirmed before service begins.
Court Document Retrieval
Standard Document Retrieval — From $95
Get Em Served can retrieve available court-file documents and records from supported Santa Clara County court locations. Certified-copy fees, court charges and other third-party fees may be additional.
Rush Document Retrieval — From $135
Rush retrieval is available for assignments requiring higher scheduling priority, subject to court availability and access.
Skip Tracing — $100 Per Person
Skip tracing provides address-location research when an address is outdated, incomplete or a person may have moved. When available, results may include prior address history, recently associated addresses and a likely current residence.
Skip-trace results are based on available records and should be treated as investigative leads rather than guaranteed facts. A reported address does not guarantee that the subject currently lives there, will be present there or can be successfully served at that location.
Process Serving Is Not Guaranteed
Successful service cannot be guaranteed. Process-serving fees compensate Get Em Served for the professional work performed on the assignment, including administrative handling, dispatch, travel, service attempts, documentation and applicable completion records.
A recipient may have moved, may not be present during the service period, may have an irregular schedule, may reside behind restricted access or may otherwise be unavailable for reasons outside our control.
An unsuccessful service attempt still constitutes work performed on the assignment.
How to Order Process Serving
- Submit the legal documents you need served.
- Provide the recipient's name, service address, deadline and any available identifying information.
- Select the service level that matches the timing of your assignment.
- Get Em Served reviews the assignment and requests any additional information needed.
- Payment is required before the assignment is dispatched unless separate billing arrangements have been approved.
- Service attempts are performed and documented according to the purchased service level and assignment circumstances.
- The appropriate proof, declaration or completion record is prepared when applicable.

How many attempts are included?
Process-serving service levels generally include up to three attempts for one recipient at one authorized service address unless otherwise stated in your invoice or service-specific terms.
Does Priority or Urgent service guarantee successful service?
No. Expedited service levels provide faster scheduling priority and intended first-attempt windows. They do not guarantee that the recipient will be located or successfully served.
What happens if I provide another address?
An additional or replacement service address is generally outside the scope of the original one-address service fee and may require an additional charge.
Are court filing fees included?
Government filing fees, certified-copy fees, electronic filing provider charges and similar third-party expenses may be separate from Get Em Served's service fee.
Does process-serving pricing include filing the proof of service?
Court filing of a proof of service is separate unless filing is specifically included in the service purchased, stated on the invoice or separately requested and paid for.
