Terms of Service
Effective Date: September 7, 2026
These Terms of Service ("Terms") govern your use of the Get Em Served website, services, client portal, online ordering systems, and any services ordered from Get Em Served ("Get Em Served," "we," "us," or "our").
By using this website, submitting an order, requesting services, paying an invoice, or otherwise engaging Get Em Served, you agree to these Terms.
If you do not agree to these Terms, do not use our services.
1. Our Services
Get Em Served provides professional legal support services that may include:
- Service of process
- Delivery of legal documents
- Preparation of proofs, declarations, or affidavits relating to services performed
- Court filing and e-filing when specifically ordered
- Skip tracing and address-location research
- Court document retrieval
- Other attorney-support or legal-support services specifically agreed upon
The availability, price, scope, and conditions of a particular service may vary depending on the location, documents, deadline, circumstances, and information provided by the client.
Services not expressly included in an order, invoice, or written confirmation are not included.
2. Not a Law Firm — No Legal Advice
Get Em Served is not a law firm and does not provide legal advice or legal representation.
Information provided on our website, by telephone, by email, through an AI-assisted system, by a process server, or by any member of our staff is provided for general informational and service-coordination purposes only.
We do not determine or guarantee:
- Which method of service is legally required
- Whether a particular method of service is legally sufficient
- Whether substituted service is permitted
- Whether a court will accept a proof of service
- Whether service will result in jurisdiction over a party
- Filing or response deadlines
- Litigation strategy
- The legal effect of any document or service attempt
Clients are responsible for obtaining legal advice from a qualified attorney when necessary.
3. Client Responsibility
The client is responsible for providing complete, accurate, and timely information necessary to perform the requested service.
This may include:
- Correct legal documents
- Complete copies of all documents requiring service
- Correct names of the parties
- Service addresses
- Physical descriptions or photographs when available
- Vehicle information when available
- Known schedules
- Hearing dates
- Court deadlines
- Case numbers
- Court information
- Special service instructions
- Information regarding safety concerns
- Any legal instructions provided by the client's attorney or court
Get Em Served is not responsible for delays, failed service, rejected filings, missed deadlines, additional expenses, or other consequences resulting from inaccurate, incomplete, late, or missing information supplied by the client.
The client is responsible for determining which documents must be served and the deadline for service.
4. Authorization to Perform Services
By submitting an order, the client authorizes Get Em Served and its authorized process servers, employees, agents, or service partners to take reasonable actions necessary to perform the requested service.
This may include visiting the provided address, speaking with occupants or appropriate third parties as permitted, making service attempts at different dates and times, conducting reasonable address research, documenting attempts, and completing service-related records.
We will not knowingly engage in unlawful entry, impersonation of law enforcement, threats, physical confrontation, or other unlawful conduct in performing an assignment.
5. Service Levels and Attempt Windows
Get Em Served may offer service levels such as Standard, Priority, Urgent, Same-Day, On-Demand, or other service options.
Any stated first-attempt time, completion window, or service schedule represents the service level purchased and our intended performance schedule.
Unless Get Em Served expressly guarantees a deadline in writing, estimated attempt or completion times are not guarantees.
Timing may be affected by circumstances outside our reasonable control, including:
- Incorrect or incomplete addresses
- Gated or secured properties
- Restricted-access buildings
- Business hours
- Recipient availability
- Weather
- Traffic
- Court closures
- Property access restrictions
- Safety concerns
- Law-enforcement activity
- Natural disasters
- Technical failures
- Government restrictions
- Other circumstances beyond our reasonable control
If an assignment has a critical hearing date, statutory deadline, or other time-sensitive requirement, the client must clearly provide that information when placing the order.
6. Number of Attempts
The number of service attempts included with an order is determined by the service level purchased, invoice, written quote, or order confirmation.
Unless otherwise stated, an attempt means a bona fide visit or reasonable service effort at the authorized service location.
An unsuccessful attempt still constitutes work performed.
Get Em Served does not guarantee that a particular number of attempts will result in successful service.
Additional attempts may require additional payment.
7. One Recipient and One Address
Unless specifically stated otherwise in the order or invoice, quoted process-serving fees apply to:
One person or entity at one service address.
Additional parties, defendants, witnesses, businesses, agents, addresses, units, workplaces, or locations may require separate or additional fees.
If the original address is determined to be incorrect, vacant, inaccessible, outdated, or no longer associated with the subject, work at another address is not automatically included unless expressly stated in the service purchased.
Get Em Served will obtain authorization or payment when additional charges are required.
8. No Guarantee of Successful Service
Payment is for professional time, service attempts, administrative work, travel, documentation, and other services performed.
Get Em Served does not guarantee that a person or entity will be successfully served.
A recipient may:
- Not be present
- Have moved
- Provide an incorrect address
- Be unavailable
- Avoid contact
- Work irregular hours
- Reside within a secured property
- Be inaccessible for reasons outside our control
An unsuccessful service assignment does not mean the contracted services were not performed.
Fees are therefore not contingent upon successful service unless Get Em Served expressly agrees otherwise in writing.
9. Evasive or Difficult Service
Get Em Served may accept assignments involving individuals believed to be avoiding service.
These assignments may require additional work, additional attempts, alternate addresses, extended observation, specialized scheduling, or other services outside a standard process-serving package.
Additional services are subject to availability and additional fees.
No representation is made that an evasive or difficult-to-locate individual will ultimately be served.
10. Service at Businesses, Workplaces, Gated Properties, and Restricted Locations
Service at businesses, workplaces, apartment communities, gated properties, government facilities, hospitals, schools, secured buildings, military facilities, correctional institutions, or other restricted locations may be subject to access rules beyond our control.
Get Em Served is not responsible when access is denied or restricted by a property owner, employer, security officer, government agency, facility administrator, or other authorized person.
Additional attempts or alternative service locations may require additional fees.
11. Substituted or Alternative Service
Certain matters may permit substituted, mailed, posted, electronic, court-authorized, or other forms of service.
The availability of any particular method depends on the applicable law, court rules, documents, jurisdiction, and specific circumstances.
Get Em Served does not provide legal advice regarding which method is legally appropriate.
Where additional mailing, diligence, documentation, court authorization, or other steps are required, additional charges may apply unless specifically included in the purchased service.
12. Proof of Service and Declarations
When applicable to the service performed, Get Em Served will prepare a proof of service, declaration of service, declaration of non-service, declaration of due diligence, affidavit, or similar service record.
The form used depends on the documents, jurisdiction, service performed, and information available to the server.
The client is responsible for reviewing documents received from Get Em Served and promptly notifying us of any apparent error.
Preparation of a proof of service does not automatically include filing that proof with a court.
13. Court Filing of Proof of Service
Court filing is included only when:
- The service purchased specifically states that filing is included
- The client's invoice specifically includes court filing
- Get Em Served separately confirms in writing that filing will be performed
Otherwise, the client is responsible for filing the completed proof of service with the appropriate court.
Court filing fees, electronic filing provider fees, convenience fees, or other third-party charges may be billed separately.
Get Em Served is not responsible for a court's rejection of a filing for reasons outside our control.
14. GPS, Photographs, and Service Documentation
Where available and appropriate, Get Em Served may use GPS records, photographs, timestamps, field notes, electronic records, or other technology to document service attempts.
Such documentation is maintained for internal quality control, service verification, or client reporting as appropriate.
The availability of GPS or photographic documentation is not guaranteed for every assignment.
We may decline to provide photographs or other information when doing so could compromise safety, privacy, confidential information, or another legitimate interest.
15. Payment
Unless otherwise agreed in writing, payment is required before services begin.
We may accept payment through approved electronic payment methods, invoices, credit or debit cards, or other methods made available by Get Em Served.
An order is not considered accepted merely because information has been submitted through the website.
We may require:
- Additional information
- Additional documents
- Additional payment
- Confirmation of the service address
- Clarification of instructions
before beginning an assignment.
16. Additional Fees
Additional charges may apply for services outside the scope of the original order, including but not limited to:
- Additional recipients
- Additional addresses
- Additional service attempts
- Incorrect addresses
- Address changes
- Difficult or evasive service
- Restricted service windows
- Extended waiting or observation
- Stakeout-type assignments
- Rural or distant locations
- Parking or toll expenses
- Court filing
- E-filing fees
- Court fees
- Rush service
- Same-day requests
- Document printing beyond ordinary quantities
- Additional mailing requirements
- Skip tracing
- Specialized affidavits or declarations
- Other unusual requirements
Where reasonably practicable, Get Em Served will advise the client before incurring additional discretionary charges.
17. Cancellations
Orders are processed promptly after payment or acceptance.
A request to cancel an assignment must be submitted as soon as possible.
Cancellation does not automatically entitle the client to a refund.
Once administrative work, document review, dispatch, travel, investigation, an attempted service, filing work, or other performance has begun, fees attributable to work already performed are non-refundable.
If an assignment is cancelled before substantive work begins, Get Em Served may, in its discretion and subject to payment-processing or administrative costs, issue a full or partial refund.
Any special cancellation or refund terms stated on an invoice, order confirmation, or service-specific agreement will control over this general provision.
18. Refunds
Service fees compensate Get Em Served for work performed and are not conditioned upon successful service.
No refund is owed solely because:
- The recipient was not located
- Service was unsuccessful
- The recipient moved
- An address was incorrect
- A property was inaccessible
- The recipient avoided service
- The client no longer requires service after work begins
- The client's case settles, is dismissed, postponed, or otherwise changes
- The documents become unnecessary after the assignment begins
Requests involving alleged billing errors or service issues will be reviewed individually.
Nothing in these Terms limits any refund or consumer right that cannot lawfully be waived.
19. Chargebacks and Payment Disputes
Clients should contact Get Em Served promptly regarding any billing concern so we have an opportunity to investigate and resolve the issue.
Filing a payment dispute or chargeback does not eliminate responsibility for legitimate charges for services actually authorized and performed.
We reserve the right to provide order records, service attempts, correspondence, GPS documentation, photographs, signed proofs, invoices, and other appropriate records to a payment processor or financial institution in connection with a payment dispute.
20. Skip Tracing and Address-Location Services
Get Em Served may offer lawful skip-tracing or address-location research for legitimate purposes.
Skip-tracing results are based on information available from permissible sources and may contain inaccuracies, outdated information, incomplete information, or information relating to another person with a similar name.
We do not guarantee that:
- A person will be located
- A reported address is current
- A reported address is residential
- The subject will be present at the reported address
- Information obtained will result in successful service
The client agrees to use skip-tracing information only for a lawful and permissible purpose.
Get Em Served does not provide consumer reports for purposes prohibited by applicable law.
21. Court Filing and E-Filing Services
Where court filing or electronic filing services are purchased, the client is responsible for providing complete and accurate documents and filing instructions.
Court fees, e-filing service-provider fees, convenience fees, and other third-party charges may be additional.
Get Em Served does not control:
- Court filing systems
- Court processing times
- E-filing service providers
- Court clerks
- Filing acceptance or rejection
- Court outages
- Changes to court procedures
We are not responsible for rejection or delay caused by the content or format of documents supplied by the client, court system failures, third-party provider failures, incorrect filing instructions, or circumstances outside our reasonable control.
22. Deadlines
The client bears ultimate responsibility for identifying and communicating all legal deadlines.
Get Em Served does not independently calculate legal deadlines unless expressly agreed as part of a separate service and legally permitted.
Submission of an order near a deadline does not guarantee that service or filing can be completed before that deadline.
An assignment requiring immediate or expedited handling must be clearly identified as urgent when the order is placed.
23. Client Communications
Clients are responsible for providing accurate telephone numbers and email addresses and for monitoring communications from Get Em Served.
We may communicate regarding an assignment by:
- Telephone
- Voicemail
- Text message
- Client portal
- Automated notification
- AI-assisted communication system
A client who fails to respond to a request for additional information, instructions, or payment may cause an assignment to be delayed or suspended.
24. AI-Assisted Telephone and Communication Systems
Get Em Served may use automated or artificial-intelligence-assisted systems to answer calls, collect information, respond to routine questions, summarize communications, route inquiries, or assist with customer service.
Such systems are provided for informational and administrative assistance.
An AI-assisted response does not constitute legal advice, a legal opinion, or a guarantee regarding any assignment.
If an automated response conflicts with a written invoice, order confirmation, or direct written communication from an authorized representative of Get Em Served, the written order-specific communication controls.
25. Confidentiality
Get Em Served takes reasonable measures to protect client and assignment information.
We may disclose information when reasonably necessary to:
- Perform an authorized service
- Complete court documents
- Work with an authorized service partner
- Process payment
- Comply with law
- Respond to a subpoena or court order
- Protect our legal rights
- Address a payment dispute
- Protect the safety of our personnel or others
Clients should not transmit highly sensitive information that is unnecessary to complete the requested service.
Our collection and handling of personal information is also governed by our Privacy Policy .
26. Safety and Right to Refuse or Terminate Service
Safety takes priority over completion of any assignment.
Get Em Served may delay, suspend, refuse, or terminate an assignment when we reasonably believe that performing it may expose a process server, employee, member of the public, or other person to an unreasonable risk.
This includes circumstances involving:
- Threats
- Weapons
- Violence
- Aggressive animals
- Unsafe property conditions
- Unlawful activity
- Hostile confrontations
- Instructions requesting unlawful conduct
- Harassment
- Misrepresentation
- Fraudulent purposes
The client must disclose known safety concerns before service begins.
Failure to disclose a known material safety risk may result in termination of the assignment without refund for work already performed.
27. Prohibited Use
You may not use Get Em Served or our website to:
- Harass, threaten, stalk, intimidate, or harm another person
- Obtain information for an unlawful purpose
- Commit fraud
- Impersonate another person
- Circumvent court orders or legal restrictions
- Facilitate illegal activity
- Request unlawful entry onto private property
- Request physical confrontation with a recipient
- Misuse personal information
- Submit knowingly false information
- Interfere with our systems or operations
- Violate applicable law
We may refuse or terminate any assignment that we reasonably believe involves an unlawful, fraudulent, abusive, or improper purpose.
28. Third-Party Service Providers
Get Em Served may use qualified third parties when reasonably necessary to complete an assignment, including process servers, filing services, court runners, technology providers, payment processors, mailing services, investigators or research providers where legally appropriate, and other professional service partners.
Use of a third party does not change the scope of the service purchased.
Third-party fees may apply where disclosed or authorized.
29. Website Information
We make reasonable efforts to keep information on our website accurate and current.
However, website content may occasionally contain errors or outdated information.
Pricing, service areas, service levels, deadlines, features, policies, and availability may change.
For a specific assignment, the applicable written quote, invoice, checkout terms, order confirmation, or direct written communication from Get Em Served controls over general website content.
30. Intellectual Property
Unless otherwise indicated, the Get Em Served name, branding, website design, text, graphics, photographs, logos, service descriptions, and other original website content are owned by or licensed to Get Em Served.
You may not reproduce, distribute, modify, publish, sell, or commercially exploit this content without prior written permission except as permitted by law.
31. Disclaimer of Warranties
To the maximum extent permitted by law, services and website content are provided on an "as available" basis.
Get Em Served does not warrant that:
- Every service attempt will be successful
- Every recipient will be located
- Every filing will be accepted
- Every deadline will be met
- The website or client portal will always be uninterrupted
- Third-party information will always be accurate
- Service results will produce a particular legal outcome
Nothing in this provision excludes any warranty or right that cannot legally be excluded.
32. Limitation of Liability
To the maximum extent permitted by law, Get Em Served will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of our website or services, including lost profits, lost business, lost opportunities, or adverse litigation results.
Where liability cannot lawfully be excluded, Get Em Served's liability arising from a particular service will, to the maximum extent permitted by law, be limited to the amount paid to Get Em Served for the specific service giving rise to the claim.
These limitations do not apply where prohibited by law.
33. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Get Em Served and its owners, employees, agents, process servers, and authorized service providers from third-party claims, losses, liabilities, costs, or expenses arising from:
- False or misleading information supplied by you
- Unlawful instructions supplied by you
- Your misuse of information obtained through our services
- Your violation of these Terms
- Your violation of another person's rights
This provision does not require indemnification for conduct for which indemnification cannot lawfully be required.
34. Force Majeure
Get Em Served is not responsible for delay or nonperformance caused by events reasonably outside our control, including natural disasters, severe weather, fires, power failures, telecommunications outages, court closures, government action, civil emergencies, strikes, transportation disruptions, widespread technical failures, or similar events.
35. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any legal action arising from these Terms or services provided by Get Em Served shall be brought in a court of competent jurisdiction in Santa Clara County, California.
36. Severability
If any portion of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
37. No Waiver
Failure by Get Em Served to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
38. Entire Agreement
These Terms, together with the applicable order, invoice, written quote, service-specific terms, Privacy Policy, and any written instructions accepted by Get Em Served, constitute the agreement concerning the services ordered.
If a service-specific written agreement or invoice expressly conflicts with these general Terms, the service-specific written provision controls for that assignment.
39. Changes to These Terms
Get Em Served may update these Terms periodically.
The current version will be posted on this website with the applicable effective date.
Changes apply prospectively unless otherwise permitted by law.
Services ordered before a material change remain subject to any order-specific terms that were applicable when the service was accepted.
